Warranty Terms for Goods
These warranty terms apply to high-pressure hoses (hereinafter – HP hoses) supplied by the Seller.
Warranty Period
The warranty for hidden defects of the goods is valid for 12 months from the date of shipment to the Buyer, provided the goods are operated in accordance with the requirements of the standard. The shipment date is the date on the invoice (TORG-12) by which the goods are shipped. In case of shipment under EXW terms from the manufacturer’s plant, this is the date on the CMR. Warranty replacement of defective goods is carried out free of charge only at the Seller’s warehouse. All transportation costs related to the replacement are borne by the Buyer. The warranty covers only structural defects of the goods. The decision to recognize a warranty case is made by the Seller in agreement with the manufacturer.
Warranty Limitations
The warranty terms apply only to direct buyers of the company. The warranty applies only to products that were installed and commissioned in accordance with the Seller’s instructions.
The length of supplied hoses is agreed between the Buyer and the Supplier; the permissible deviation from the agreed coil length is ±2%.
The warranty does not cover leaks and damages caused by improper product selection, use with incompatible products, incorrect assembly (connection) with other products, modifications to the product design, violation of operating rules specified in the Seller’s catalogs, manuals, and other technical documents, use exceeding the maximum pressure, unauthorized repairs not agreed with the Seller. The Supplier is not responsible for all risks related to intentional or unintentional improper use; damage to personnel caused by product defects; operational losses, as well as any other additional losses and expenses, including losses caused to third parties.
The warranty does not cover products whose storage conditions did not comply with EN, DIN, ISO standards and the Seller’s technical recommendations, or if the product’s shelf life has expired.
The Seller is responsible for the operability and safety of the supplied components, but not for the operation of the entire system.
The Seller does not provide a warranty for hoses in case of incorrect cutting and/or crimping. The Seller reserves the right to assess the actions and qualifications of the Buyer’s equipment operators.
When ordering products according to the Buyer’s project/drawings, the Seller is responsible for the technical design, but not for the expected properties of the product.
Actions Upon Defect Detection
In case a defect is detected during acceptance or operation (within the warranty period), it is necessary:
a. Submit an official claim to our company indicating the circumstances of the defect and describing the problem, the date, and the document number under which the product was purchased. When submitting a claim, it is mandatory to provide photo and/or video materials demonstrating the defect. Claims for visible defects must be submitted within 3 calendar days from the date of product receipt. Claims for hidden defects must be submitted within the warranty period, but no later than 7 days before the end of the warranty obligations.
If the Seller does not receive comments from the Buyer, the products are considered accepted by the Buyer; further claims may only be made for hidden defects within the warranty period.
If product damage occurred during transportation, the claim must be made to the carrier, not the Seller.
b. Claims for hidden defects must be submitted within the warranty period, but no later than 7 days before the end of the warranty obligations.
c. If the cause of the defect and the warranty case cannot be established based on the Buyer’s materials, the goods shall be sent to the Supplier’s warehouse at the Buyer’s expense. All goods must be returned in the original packaging or packaging preventing damage during transportation. Further, the Supplier will analyze the goods and prepare an inspection report and technical conclusion. If the case is recognized as warranty-covered, the defective goods will be replaced with new ones under EXW Seller’s warehouse terms.
