“These warranty terms apply to sales contracts concluded by LLC “Hydravia” INN 7806158571 and LLC “Hydral” INN 7802374966 with buyers and are an integral part thereof. The warranty terms are a public offer and cannot be changed.

Warranty Terms for Goods

These warranty terms apply only to used Equipment supplied by the Seller, previously operated by consumers, i.e., not new.

The Seller is responsible for warranty obligations regarding the sold used Equipment in accordance with Russian Federation legislation.

Used Equipment is sold on an “as is” basis:

  • without technical maintenance or repair (i.e., without replacement of worn spare parts, consumables, or restoration of its original commercial appearance);
  • according to the available configuration (tooling, etc.).

Before shipment, the equipment is checked for suitability (operability) for the purposes specified in the manual and operating instructions.

Acceptance of the used Equipment by the Buyer is carried out within three days from the date of receipt of the goods. If the Seller does not receive any claims from the Buyer during this period, the shipped goods are considered accepted without comments.

All comments regarding the unsuitability of further use of the supplied used Equipment are noted by the Buyer in the Used Equipment Inspection Checklist, which is agreed with the Seller.

The deadlines for submitting claims to the Seller regarding the operation of the used Equipment are within the warranty periods established (by contract).

The warranty terms do not provide for technical maintenance, repair, or replacement of worn parts or consumables of the used Equipment by the Seller at his expense. If the Buyer pays for such services, a corresponding warranty is provided for them. Spare parts provided under warranty cases for replacement may be new or refurbished, but in any case, the Seller guarantees that their characteristics will be no worse than those of the replaced spare part.

Warranty Period

A warranty period of one month is provided for the sold used Equipment and related services.

The warranty period for such used Equipment is counted from the date of shipment to the Buyer.

The shipment date is the date of the consignment note (TORG-12) by which the goods are shipped.

Warranty Limitations

The warranty terms apply only to direct buyers.

The Seller is not responsible for all risks associated with intentional or unintentional improper use; damage to personnel caused by a product defect; losses during operation, as well as any other additional losses and costs, including losses caused to third parties and lost profits.

The warranty applies only to used Equipment installed and operated in accordance with the Manufacturer’s instructions and the Seller’s recommendations.

The Seller is responsible for the operability and safety of the used Equipment supplied by him, but not for the operation process and result if actions were performed by specialists with insufficient qualifications. The Seller reserves the right to assess the qualifications of the Buyer’s used Equipment operators.

Warranty Does Not Cover:

  • appearance defects of the used Equipment (absence of factory paint coating, dents, chips, scratches on the body, etc.) that do not affect its operability;
  • consumables and worn parts of this used Equipment (pressure block, hydraulic block, control panel, motor, electronics, etc.);
  • accessories and additional options for this used Equipment.

Warranty Does Not Apply In Case Of:

  • improper installation of the used Equipment;
  • violations of the rules (instructions and manuals) for operation;
  • improper use of the used Equipment;
  • failure to use safety devices of the used Equipment;
  • modifications to the design of the used Equipment;
  • violation of transportation and storage conditions;

Actions Upon Detection of a Defect During the Warranty Period:

a. Send an official claim to our company, indicating the circumstances of occurrence and describing the problem, the date and number of the document under which the goods were purchased. When submitting a claim, it is mandatory to specify the equipment model, serial number, and year of manufacture, as well as provide photo or video materials demonstrating the defect. The deadline for accepting claims for visible defects is 3 business days from the date of receipt of the product. The deadline for accepting claims for hidden defects is determined by the warranty period, but no later than 7 days before the end of the warranty obligations. If the Seller does not receive any comments from the Buyer, the product is considered accepted by the Buyer; further claims can only be made for hidden defects within the warranty period. If the product was damaged during transportation, the claim must be made to the carrier, not the Seller.

b. If the claim can be resolved by telephone or written consultations, the Supplier sends a new product to replace the defective one free of charge under warranty, with transportation costs borne by the Buyer.

c. If it is impossible to determine the cause of the defect and the fact of a warranty case based on the Buyer’s materials, the product is sent to the Supplier’s warehouse at the Buyer’s expense and effort. All products must be returned in original packaging or packaging that prevents damage during transportation. Subsequently, at the Supplier’s premises, an acceptance report (TORG-1) is drawn up, the product is diagnosed, and a technical conclusion on the condition of the product is prepared.

If based on the diagnostics the case is recognized as a warranty case, the defective product is replaced with a new one on EXW Seller’s warehouse terms. If the case is not recognized as a warranty case, the product is returned within 5 (Five) business days after notifying the Buyer and payment by the Buyer of:

  1. diagnostics (in case of refusal of subsequent repair or replacement of defective product);
  2. repair or replacement of defective product;
  3. storage costs from the moment the product is handed over for diagnostics until its return to the Buyer.

Transportation conditions and safety requirements are additionally specified in the used Equipment operation manual (instructions).

Open claims cannot be a reason for the Buyer to delay payment to the Seller.

The Seller reserves the right to make technical changes to the used Equipment without notifying Buyers.

The Buyer is responsible for the disposal of used Equipment, components, and used oil, which must be carried out in accordance with applicable legal regulations.

*Used Equipment means previously operated equipment.
