Warranty Terms for Goods

These warranty terms apply to new equipment at the time of sale, supplied by the Seller.

Warranty Period

Warranty on hidden defects of the Goods is valid for 12 months from the shipment date to the Buyer, provided operation complies with GOST requirements and Seller’s recommendations. The shipment date is the date on the delivery note (TORG-12) by which the Goods are shipped. For EXW shipments, this is the date on the CMR. Warranty replacement of defective Goods is free of charge only at the Seller’s warehouse. All transportation costs related to replacement are borne by the Buyer. Warranty covers only structural defects. The decision to recognize a warranty case is made by the Seller in agreement with the manufacturer.

Warranty Limitations

Warranty applies only to direct customers of the company. Warranty applies only to equipment whose installation and operation were performed according to the Seller’s instructions.

Warranty does not apply in cases of:

  • incorrect installation, violation of operating rules specified in catalogs, instructions, and other technical documents of the Seller;
  • improper use of the equipment;
  • design modifications;
  • unauthorized repairs not approved by the Seller;
  • use of non-original components and spare parts;
  • absence or improper scheduled maintenance; failure to use safety devices;
  • violation of transportation and storage conditions.

Upon claim submission, the Buyer must provide maintenance records. The maintenance schedule and frequency are specified in the operation manuals.

Warranty does not cover consumables and rapidly wearing parts. The Seller is not responsible for all risks related to intentional or unintentional improper use; damage to personnel caused by product defects; operational losses; and any other additional losses and expenses, including losses caused to third parties and lost profits.

Warranty will not be confirmed in case of severe wear or absence of factory nameplate on the equipment.

The Seller is responsible for the operability and safety of the equipment supplied but not for the operation process and results if actions were performed by specialists with insufficient qualifications. The Seller reserves the right to assess the qualification of the Buyer’s equipment operators.

Actions Upon Defect Detection

In case a defect is detected during acceptance or operation (within the warranty period), it is necessary to:

a. Submit an official claim to our company indicating circumstances and describing the problem, date, and document number under which the Goods were purchased. When submitting a claim, it is mandatory to specify the equipment model, serial number, and year of manufacture, and provide photo or video materials demonstrating the defect. Deadlines for claims on visible defects are 3 working days from product receipt. Deadlines for claims on hidden defects correspond to the warranty period but no later than 7 days before warranty expiration. If no remarks are received, the product is considered accepted; further claims may only be made on hidden defects within the warranty period. If damage occurred during transportation, the claim must be directed to the carrier, not the Seller.

b. If the claim can be resolved by telephone or written consultations, the Supplier sends a new product to replace the defective one free of charge under warranty, with transportation costs borne by the Buyer.

c. If the cause of the defect and warranty case cannot be established based on Buyer’s materials, the Goods shall be sent to the Supplier’s warehouse at Buyer’s expense. All Goods must be returned in original or protective packaging preventing damage during transportation. The Supplier will prepare an acceptance report, conduct diagnostics and repairs, and issue a technical conclusion on the Goods’ condition.

If the case is recognized as warranty-covered, the defective Goods are replaced with new ones on EXW Seller’s warehouse terms. If not recognized, the Goods are returned within 5 working days after notifying the Buyer and receiving payment for diagnostics, repair/replacement, and storage costs.

Warranty Repair Time

Warranty repair at the Supplier’s service center, if spare parts are available, is performed within 10 working days from equipment arrival. If spare parts are unavailable, repair time is extended by delivery time and agreed with the Buyer.

General Information

Technical specifications and intended use are indicated in the catalog and on the official Seller’s website (www.hydravia.ru). Transportation conditions and safety requirements are additionally specified in the operation manual.

Unresolved claims cannot be a reason for the Buyer to delay payment to the Seller.

The Seller reserves the right to make technical changes to the equipment without notifying Buyers.

The Buyer is responsible for disposal of equipment, components, packaging, and used oil in accordance with applicable laws.
