Warranty Terms for Goods

These warranty terms apply to new pipeline cleaning equipment at the time of sale (Blowdown hose kits, blowdown guns, blowdown nozzles, blowdown projectiles, adapters, cases, flanges, and others; hereinafter - equipment) supplied by the Seller.

Warranty Period

The warranty for hidden defects of the goods is valid for 12 months from the date of shipment to the Buyer, provided the equipment is operated according to the instruction manual and the Seller’s recommendations. The shipment date is the date of the consignment note (TORG-12) by which the goods are shipped. In case of shipment on EXW manufacturer’s plant terms, it is the date of the CMR. Warranty replacement of defective goods is carried out free of charge only at the Seller’s warehouse. All transportation costs related to replacement, diagnostics, and repair are borne by the Buyer. The warranty covers only design defects. The decision to recognize a warranty case is made by the Seller in agreement with the manufacturer.

Warranty Limitations

The warranty applies only to equipment installed and operated in accordance with the Seller’s instructions.

The warranty does not apply in cases of:

  • improper installation, connection, adjustment, violation of operating rules specified in the Seller’s catalogs, instructions, and other technical documents;
  • improper use;
  • modifications to the design;
  • unauthorized repairs not approved by the Seller;
  • use of non-original components and spare parts;
  • absence or improper scheduled maintenance;
  • failure to use safety devices during operation;
  • violation of transportation and storage conditions;
  • significant wear of working parts;
  • mechanical damage (falls, impacts, etc.);
  • absence of factory marking (nameplate).

Consumables and fast-wearing parts of the equipment are also excluded from the warranty.

The Seller is not responsible for all risks associated with intentional or unintentional improper use of the equipment; damage to personnel caused by product defects; losses during operation, lost profits, as well as any other additional losses and costs, including damages caused to third parties and lost profits.

The Seller is responsible for the operability and safety of the equipment supplied, but not for the operation process and results if actions were performed by specialists with insufficient qualifications.

Actions Upon Defect Detection

In case a defect is detected during acceptance or operation (within the warranty period), it is necessary to:

  • Send an official claim to the Seller, indicating the circumstances of occurrence and describing the problem, the date and number of the document under which the equipment was purchased. When submitting a claim, it is mandatory to specify the equipment model, serial number, and year of manufacture, as well as provide photo or video materials demonstrating the defect, explain the nature of the malfunction, and the operating conditions of the equipment. Provide maintenance service records of the machines (upon Seller’s request). The procedure and frequency of maintenance are specified in the operating instructions.

The deadline for accepting claims for visible defects is 3 business days from the date of receipt of the equipment. The deadline for claims for hidden defects is within the warranty period, but no later than 7 calendar days before the end of the warranty obligations. If the Seller does not receive any comments from the Buyer, the equipment is considered accepted by the Buyer; further claims may only be made for hidden defects within the warranty period. If the damage occurred during transportation, the claim must be made to the carrier, not the Seller.

  • If the claim can be resolved by telephone or written consultations, the Seller sends a new spare part to replace the defective one (with replacement instructions) free of charge under warranty, with transportation costs borne by the Buyer.
  • If the cause of the defect and the fact of a warranty case cannot be established based on the Buyer’s materials, the equipment is sent to the Seller’s warehouse at the Buyer’s expense and effort. All equipment must be returned in original packaging or packaging preventing damage during transportation. Subsequently, at the Seller’s premises, an acceptance-transfer act and diagnostic and repair report are prepared, the equipment is diagnosed, and a technical conclusion on the equipment condition is issued.

If based on diagnostics the case is recognized as a warranty case, the Seller fulfills warranty obligations in the following order:

- repair;

- price reduction if the identified defect does not affect the consumer properties of the equipment;

- replacement of the equipment with an identical one;

- if replacement is impossible – refund of the cost of the equipment or its part, if part of the equipment is deemed fit for use.

Shipment of equipment is performed on EXW Seller’s warehouse terms; transportation costs are paid by the Buyer.

If based on diagnostics the case is not recognized as a warranty case, the equipment is returned within 5 (five) business days after notifying the Buyer and payment by the Buyer to the Seller of the following costs:

1. diagnostics (in case of refusal of subsequent repair or replacement of defective equipment);

2. repair or replacement of defective equipment;

3. storage costs from the moment the equipment is handed over for diagnostics until its return to the Buyer.

Warranty Repair Periods

Warranty repair at the Seller’s service center, if spare parts are available, is carried out within 10 business days from the date the equipment is received at the service center. If spare parts for equipment repair are not available, the repair period is extended by the supply period of these spare parts and is additionally agreed with the Buyer.

General Information

Technical specifications and the purpose of the equipment are specified in the catalog and on the official website of the Seller (www.hydravia.ru), transportation conditions and safety requirements are additionally specified in the equipment operation manual (instructions).

Unresolved claims cannot be a reason for the Buyer to delay payment to the Seller.

The Seller reserves the right to make technical changes to the equipment without notifying Buyers.

The Buyer is responsible for the disposal of equipment, components, packaging, and used oil, which must be carried out in accordance with applicable legal regulations.
