Warranty Terms for Goods
These warranty terms apply to new Stopflex hose retention systems at the time of sale: Stopflex restraint system, Stopflex clamps, textile clamps, supplied by the Seller.
Warranty Period
The warranty for hidden defects of the goods is valid for 12 months from the date of shipment to the Buyer, provided the goods are operated according to applicable standards (if applicable for this type of goods) and the Seller’s recommendations. The shipment date is the date of the consignment note (TORG-12) by which the goods are shipped. In case of shipment on EXW manufacturer’s plant terms, it is the date of the CMR. Warranty replacement of defective goods is carried out free of charge only at the Seller’s warehouse. All transportation costs related to replacement and diagnostics are borne by the Buyer. The warranty covers only design defects. The decision to recognize a warranty case is made by the Seller in agreement with the manufacturer. The warranty applies to design defects of the goods.
The manufacturer’s warranty for hidden defects is valid for 12 months.
Warranty Limitations
The warranty terms apply only to direct buyers of the company. The warranty applies only to products installed and commissioned in accordance with the Seller’s instructions.
The warranty does not cover leaks and damages caused by improper product selection, use with incompatible products, improper assembly (connection) with other products, design modifications, violations of operating rules specified in the Seller’s catalogs, instructions, and other technical documents, and unauthorized repairs not approved by the Seller. The Supplier is not responsible for all risks related to intentional or unintentional improper use; damage to personnel caused by product defects; losses during operation; lost profits; and any other additional losses and costs, including damages caused to third parties. The Seller is responsible for the operability and safety of the components supplied but not for the operation of the entire system as a whole.
Actions Upon Defect Detection
In case of defect detection during acceptance or operation (within the warranty period), it is necessary to:
-
Send an official claim to our company, indicating the circumstances of occurrence and describing the problem, the date and number of the document under which the goods were purchased. For remote determination of whether the case is warranty-related, the Buyer shall additionally provide photo and video materials showing the defect upon the Supplier’s request. The deadline for accepting claims for visible defects is 7 calendar days from the date of receipt of the product. The deadline for accepting claims for hidden defects is within the warranty period, but no later than 7 days before the end of the warranty obligations.
If the Seller does not receive any comments from the Buyer, the product is considered accepted by the Buyer; further claims can only be made for hidden defects within the warranty period.
If the product was damaged during transportation, the claim must be made to the carrier, not the Seller.
-
If the claim can be resolved by telephone or written consultations, the Supplier sends a new product to replace the defective one free of charge under warranty, with transportation costs borne by the Buyer.
-
If it is impossible to determine the cause of the defect and the fact of a warranty case based on the Buyer’s materials, the goods are sent to the Supplier’s warehouse at the Buyer’s expense and effort. All goods must be returned in original packaging or packaging preventing damage during transportation. Subsequently, at the Supplier’s premises, the goods are analyzed and an inspection report and technical conclusion are prepared. If the case is recognized as warranty-related, the defective goods are replaced with new ones on EXW Seller’s warehouse terms.
General Information
Technical specifications of the goods are indicated in the catalog and on the official website of the Seller (www.hydravia.ru), in the relevant standards and/or drawings.
Open claims cannot be a reason for the Buyer to delay payment to the Seller.
The manufacturer has the right to make changes to the product that do not worsen its characteristics without notifying Buyers.
Adverse environmental conditions: ultraviolet light, ozone, salt water, chemicals (solvents, fuels, oils, lubricants, volatile chemical compounds, acids, disinfectants, and other aggressive elements) may cause premature deterioration of the tape seal;
-
The seal must be replaced every 4 years if the Stopflex system is not assembled;
-
The seal must be replaced every 2 years if the Stopflex system is assembled;
-
The STOPFLEX system must never be reused in case of hose rupture, slippage, or replacement, as this will compromise the system’s original safety characteristics. In case of reuse, the assembler will bear full responsibility.
Storage and transportation conditions: in enclosed premises where temperature and humidity fluctuations are significantly less than outdoors, in original (special) packaging protecting against destruction, damage, ultraviolet light, sunlight, ozone exposure, salt water, chemicals (solvents, fuels, oils, lubricants, volatile chemical compounds, acids, disinfectants, and other aggressive elements). Transportation in enclosed transport (containers, closed trucks) preventing direct contact with the external environment, precipitation, and contamination.
