These warranty terms and conditions refer to and are an integral part of the sales contracts concluded by Hyidravia LLC INN 7806158571 and Hydral LLC INN 7802374966 with buyers. The warranty conditions are a public offer and cannot be changed. Revision 01.10.2018. Product warranty terms
These warranty conditions apply to new equipment at the time of sale supplied by the Seller.
Warranty period
The warranty for hidden defects of the goods is valid for 12 months from the date of shipment of the goods to the Buyer, subject to operation in accordance with GOST requirements and Seller's recommendations. The date of shipment is the date of the delivery note (TRORG-12) on which the goods are shipped. In case of shipment of goods on EXW terms to the manufacturer's factory - this is the date of SMR. Warranty replacement of low-quality goods shall be made free of charge only at the Seller's warehouse. All transportation costs associated with the replacement of the goods are at the Buyer's expense. The warranty applies only to structural defects of the goods. The decision to recognize the case as warranty shall be made by the Seller in consultation with the manufacturer of the goods.
Warranty limitations
The warranty terms apply only to direct purchasers of the company. The warranty applies only to equipment that has been installed and operated in accordance with Seller's instructions.
The warranty does not apply in the event of:
- improper installation of the equipment, violations of operating rules specified in catalogs, instructions and other technical documents of the Seller;
- equipment misuse;
- modifications to the equipment;
- self-repair, unauthorized by the Seller;
- use of non-original components and spare parts;
- absence or improperly performed scheduled maintenance of the equipment; - failure to use equipment safety devices;
- violations of transportation and storage conditions.
In the event of a claim, the Buyer is obliged to provide certificates of maintenance performed on the machines. The procedure and frequency of maintenance are specified in the operating instructions.
The warranty does not cover consumables and wearing parts. Seller shall not be liable for all risks of intentional or unintentional misuse; damage to personnel caused by defective goods; loss of use; and any other additional damages and costs, including damages to third parties and lost profits.
The warranty will not be confirmed in case of heavy wear and tear or if the equipment does not have a factory nameplate.
The seller is responsible for the operability and safety of the equipment he supplies, but not for the operation of the equipment and the result if it is operated by unqualified persons. The Seller reserves the right to assess the qualifications of the operators of the Buyer's equipment.
Actions when a defect is detected
If a defect is detected during acceptance or operation (during the warranty period), it is necessary:
a. Send an official claim to our company, indicating the circumstances of occurrence and describing the problem, the date and number of the document under which the product was purchased. When sending a claim, it is obligatory to specify the model of the equipment, serial number and year of manufacture, as well as to present photo or video materials demonstrating the defect. The deadline for accepting claims for visible defects is 3 working days from the date of receipt of the product. The deadlines for accepting claims for hidden defects are determined by the warranty period, but no later than 7 days before the date of expiry of the warranty. If the Seller has not received any remarks from the Buyer, the products are considered to be accepted by the Buyer; further claims can only be made for latent defects within the time limits stipulated by the warranty. In the event that the products are damaged during transportation, the claim shall be made to the carrier, but not to the Seller.
b. If the claim can be resolved by telephone or written consultation, the Supplier shall send new goods to replace the defective goods under warranty free of charge, transportation costs being at the expense of the Buyer.
c. If the cause of the defect and the fact of the warranty case cannot be established on the basis of the Buyer's materials, the goods shall be sent to the Supplier's warehouse at the Buyer's expense. All goods shall be returned in their original packaging or in packaging that excludes damage to the goods during transportation. Further, on the Supplier's territory, an acceptance certificate (TRORG-1) is drawn up, the goods are diagnosed, and a technical report on the condition of the goods is drawn up.
If according to the results of diagnostics of the goods the case is recognized as warranty, the defective goods shall be replaced with a new one, on EXW terms of the Seller's warehouse. If according to the results of diagnostics of the goods the case is not recognized as warranty, the goods are returned within 5 (Five) working days after notification of the Buyer and payment by the Seller:
- diagnostics (in case of refusal of further repair, replacement of defective goods);
- repair, replacement of defective goods;
- storage costs from the moment the goods are handed over for diagnostics until the moment they are returned to the Buyer.
Warranty repair terms
Warranty repair in the Supplier's service center, if spare parts are available, shall be performed within 10 working days from the moment the equipment is delivered to the service center. In case of absence of spare parts for equipment repair, the repair period is increased by the delivery period of these spare parts and is agreed with the Buyer additionally.
General information
Technical characteristics and purpose of the goods are specified in the catalog and on the official website of the Seller (www.hydravia.com), transportation conditions, safety requirements are additionally specified in the manual (instructions) for the operation of the equipment.
Open complaints cannot be the reason for delay in payment from the Buyer to the Seller.
The Seller has the right to make technical changes to the equipment without informing the Buyers.
The Buyer is responsible for the disposal of the equipment, components and used oil, which must take place in accordance with the applicable legal regulations.
