Warranty Terms for Goods

These warranty terms apply to equipment that is used at the time of sale (hereinafter – Used Equipment) for crimping, cutting, testing, and other processing of high-pressure hoses, as well as any pipe processing supplied by the Seller.

Used Equipment is sold on an “as is” basis:

  • without technical maintenance or repair (i.e., without replacing worn spare parts, consumables, or restoring its original commercial appearance);
  • according to the available configuration (tooling, etc.).

Before shipment, the equipment is checked for suitability (operability) for the purposes specified in the manual, operating instructions.

Acceptance of Used Equipment by the Buyer is carried out within three days from the date of receipt of the goods. If the Seller does not receive any claims from the Buyer during this period, the shipped goods are considered accepted without comments.

All comments regarding the unsuitability of further use of the supplied Used Equipment are noted by the Buyer in the Used Equipment Inspection Checklist, which is agreed upon with the Seller.

The period for submitting claims to the Seller regarding the operation of Used Equipment is within the warranty periods established (by contract).

The warranty terms do not provide for technical maintenance, repair, or replacement of worn parts, consumables of Used Equipment by the Seller at his expense. If the Buyer pays for such services, the relevant warranty is provided for them. In this case, spare parts provided under warranty cases for replacement may be new or refurbished, but in any case, the Seller guarantees that their characteristics will be no worse than those of the replaced spare part.

Warranty Period

The warranty for hidden defects of the goods is valid for one month from the date of shipment to the Buyer, provided that the equipment is operated in accordance with the Seller’s recommendations. The shipment date is the date of the consignment note (TORG-12) by which the goods are shipped. In case of shipment on EXW manufacturer’s plant terms, it is the date of the CMR. Warranty repair is carried out free of charge only at the Seller’s warehouse. All transportation costs related to replacement, diagnostics, and repair of the goods are borne by the Buyer.

 Warranty Limitations

The warranty applies only to equipment installed and operated in accordance with the Seller’s instructions.

The warranty does not apply to equipment in the following cases:

  • improper installation, connection, adjustment, violation of operating rules specified in the Seller’s catalogs, instructions, and other technical documents;
  • improper use;
  • modifications to the design;
  • unauthorized repairs not approved by the Seller;
  • use of non-original components and spare parts;
  • absence or improper scheduled maintenance;
  • failure to use safety devices during operation;
  • violation of transportation and storage conditions;
  • significant wear of working parts;
  • mechanical damage (falls, impacts, etc.);
  • absence of factory marking (nameplate).
  • spare parts provided under warranty cases for replacement may be new or refurbished
Consumables and fast-wearing parts of the equipment are also not covered by the warranty.

The Seller is not liable for any risks associated with intentional or unintentional improper use of the equipment; damage to personnel caused by a product defect; losses during operation, as well as any other additional losses and costs, including losses caused to third parties and lost profits.

The Seller is responsible for the operability and safety of the equipment supplied by him, but not for the operation process and result if actions were performed by insufficiently qualified specialists. The Seller reserves the right to assess the qualification of the Buyer’s equipment operators.

Actions in Case of Defect Detection

If a defect is detected during acceptance or operation (within the warranty period), it is necessary to:

a. Send an official claim to the Seller, indicating the circumstances of occurrence and describing the problem, the date and number of the document under which the goods were purchased. The claim must specify the equipment model, serial number, and year of manufacture, as well as provide photo or video materials demonstrating the defect, describe the essence of the malfunction, and the operating conditions of the equipment.

The period for accepting claims for visible defects is 3 business days from the date of receipt of the goods. The period for accepting claims for hidden defects is determined by the warranty period, but no later than 7 calendar days before the end of the warranty obligations. If the Seller does not receive any comments from the Buyer, the goods are considered accepted by the Buyer; further claims may be submitted only for hidden defects within the warranty period. If the damage to the goods occurred during transportation, the claim must be made to the carrier, not the Seller.

b. If the claim can be resolved by telephone or written consultations, the Seller sends a new spare part to replace the defective one (with replacement instructions) free of charge under warranty, with transportation costs borne by the Buyer.

c. If it is impossible to determine the cause of the defect and the fact of a warranty case based on the Buyer’s materials, the goods are sent to the Seller’s warehouse by and at the expense of the Buyer. All goods must be returned in original packaging or packaging that prevents damage during transportation. Subsequently, at the Seller’s premises, an acceptance and diagnostic/repair report is drawn up, the goods are diagnosed, and a technical report on the condition of the goods is prepared.

If, based on the diagnostics, the case is recognized as a warranty case, the Seller fulfills the warranty obligations in the following order:

- repair;

- price reduction if the identified defect does not affect the consumer properties of the goods;

- replacement of the goods with an identical one;

- if replacement is impossible – refund of the cost of the goods or its part, if part of the goods is deemed fit for use.

Shipment of goods is performed on EXW Seller’s warehouse terms, transportation costs are paid by the Buyer.

If, based on the diagnostics, the case is not recognized as a warranty case, the goods are returned within 5 (Five) business days after notifying the Buyer and payment to the Seller of the following costs:

1. diagnostics (in case of refusal of subsequent repair or replacement of defective goods);

2. repair, replacement of defective goods;

3. storage costs from the moment the goods are handed over for diagnostics until their return to the Buyer.

Warranty Repair Periods

Warranty repair at the Seller’s service center, if spare parts are available, is carried out within 10 business days from the date the equipment is received at the service center. If spare parts for equipment repair are not available, the repair period is extended by the supply period of these spare parts and is additionally agreed with the Buyer.

General Information

Technical specifications and the purpose of the goods are specified in the catalog and on the official website of the Seller (www.hydravia.ru), transportation conditions, and safety requirements are additionally specified in the equipment operation manual (instructions).

Unresolved claims cannot be grounds for delaying payment by the Buyer to the Seller.

The Seller has the right to make technical changes to the equipment without notifying Buyers.

The Buyer is responsible for the disposal of equipment, components, packaging, and used oil, which must be carried out in accordance with applicable legal regulations.
