These warranty terms and conditions apply to the sales contracts concluded by Hydravia LLC INN 7806158571 and Hydral LLC INN 7802374966 with buyers and are an integral part thereof.The warranty terms and conditions are a public offer and cannot be changed. Product warranty terms
These warranty conditions apply only to the goods supplied by the Seller, hereinafter referred to as Used Equipment, previously used by consumers, i.e. not new.
The Seller is liable for warranty obligations in respect of the sold used Equipment in accordance with the laws of the Russian Federation.
Used Equipment is sold on an "as is" basis:
- without its maintenance and repair (i.e. without replacing worn-out spare parts, consumables, without restoring its original trade dress);
- according to the available equipment (tooling, etc.).
Before shipment, the suitability (operability) of the equipment for the purposes stipulated in the manual, operating instructions is checked.
Acceptance of the Used Equipment by the Buyer shall be made within three days from the date of receipt of the goods. If the Seller has not received any claims from the Buyer within this period, the shipped goods shall be deemed accepted without comments.
All remarks concerning unsuitability of further use of the delivered used Equipment shall be noted by the Buyer in the Used Equipment Inspection Checklist, which shall be agreed upon with the Seller.
The terms for submitting claims to the Seller regarding the operation of the Used Equipment are within the warranty periods established (by the contract).
The warranty terms do not provide for maintenance, repair or replacement of worn parts, consumables of the Used Equipment by the Seller and at the Seller's expense. If the Buyer pays for such services, they shall be warranted accordingly. At the same time, the spare parts provided under warranty for replacement may be either new or reconditioned, but in any case the Seller guarantees that its characteristics will not be worse than those of the replaced spare part.
Warranty period
Used Equipment and related services sold are covered by a one month warranty.
The warranty period for such Used Equipment shall be calculated from the date of shipment of the goods to the Buyer.
The date of shipment is the date of the delivery note (TRORG-12) on which the goods are shipped.
Warranty limitations
Warranty terms and conditions apply to direct purchasers only.
Seller shall not be liable for all risks of intentional or unintentional misuse; damage to personnel caused by defective goods; loss of use; and any other additional damages and costs, including damages to third parties and lost profits.
The warranty applies only to second-hand Equipment that has been installed and operated in accordance with the Manufacturer's instructions and the Seller's recommendations.
The Seller is responsible for the operability and safety of the used Equipment supplied by the Seller, but not for the process of working on it and the result in case the actions were carried out by insufficiently qualified specialists. The Seller reserves the right to assess the qualifications of the operators of the Buyer's used Equipment.
The warranty does not apply to:
- defects in appearance of used Equipment (lack of factory paint coating, dents, chips, scratches, etc.) that do not affect its operability;
- consumables and worn parts of this Equipment used (pressure unit, hydraulic unit, control panel, motor, electronics, etc.);
- accessories and optional extras for this Equipment used.
The warranty does not apply in the case of:
- incorrect installation of violations of the operating regulations (instructions and manuals)used equipment;
- violations of the operating regulations (instructions and manuals);
- misuse of used Equipment;
- of non-use of safety equipment Equipment used;
- making changes to the design of used Equipment;
- violations of transportation and storage conditions;
Actions if a defect is detected during the warranty period:
a. Send an official claim to our company, indicating the circumstances of occurrence and describing the problem, the date and number of the document under which the product was purchased. When sending a claim, it is obligatory to specify the model of the equipment, serial number and year of manufacture, as well as to present photo or video materials demonstrating the defect. The deadline for accepting claims for visible defects is 3 working days from the date of receipt of the product. The deadlines for accepting claims for hidden defects are determined by the warranty period, but no later than 7 days before the date of expiry of the warranty. If the Seller has not received any remarks from the Buyer, the products are considered to be accepted by the Buyer; further claims can only be made for latent defects within the time limits stipulated by the warranty. In the event that the products are damaged during transportation, the claim shall be made to the carrier, but not to the Seller.
b. If the claim can be resolved by telephone or written consultation, the Supplier shall send new goods to replace the defective goods under warranty free of charge, transportation costs being at the expense of the Buyer.
c. If the cause of the defect and the fact of the warranty case cannot be established on the basis of the Buyer's materials, the goods shall be sent to the Supplier's warehouse at the Buyer's expense. All goods shall be returned in their original packaging or in packaging that excludes damage to the goods during transportation. Further, on the Supplier's territory, an acceptance certificate (TRORG-1) is drawn up, the goods are diagnosed, and a technical report on the condition of the goods is drawn up.
If according to the results of diagnostics of the goods the case is recognized as warranty, the defective goods shall be replaced with a new one, on EXW terms of the Seller's warehouse. If according to the results of diagnostics of the goods the case is not recognized as warranty, the goods shall be returned within 5 (Five) working days after notification of the Buyer and payment by the Seller:
- diagnostics (in case of refusal of further repair, replacement of defective goods);
- repair, replacement of defective goods;
- storage costs from the moment the goods are handed over for diagnostics until the moment they are returned to the Buyer.

Transportation conditions, safety requirements are additionally specified in the operating manual (instructions) of the Used Equipment.

Open complaints cannot be the reason for delay in payment by the Buyer to the Seller.
The Seller has the right to make technical changes to the Used Equipment without informing the Buyers.
The Buyer is responsible for the disposal of the used Equipment, accessories and used oil, which must be done in accordance with the applicable legal regulations.
