Warranty Terms for Goods
These warranty terms apply to new at the time of sale hydraulic components such as valves, filters, hydraulic distributors, rotators, grabs (grippers), hydraulic pumps, pressure gauges, and others supplied by the Seller.
Warranty Period
Warranty on hidden defects of the Goods is valid for 12 months from the shipment date to the Buyer, provided operation complies with the instructions (operation manual) for this type of Goods and Seller’s recommendations. The shipment date is the date on the delivery note (TORG-12) by which the Goods are shipped. For EXW shipments, this is the date on the CMR. Warranty replacement of defective Goods is free of charge only at the Seller’s warehouse. All transportation costs related to replacement, diagnostics, and repair are borne by the Buyer. Warranty covers only structural defects. The decision to recognize a warranty case is made by the Seller in agreement with the manufacturer.
Warranty Limitations
Warranty applies only to hydraulic components whose installation and operation were performed in accordance with the Seller’s instructions.
Warranty does not apply in cases of:
-
incorrect installation, connection, adjustment, violation of operating rules specified in the Seller’s catalogs, instructions, and other technical documents;
-
improper use;
-
design modifications;
-
unauthorized repairs not approved by the Seller;
-
use of non-original components and spare parts;
-
absence or improper performance of scheduled maintenance;
-
violation of safety regulations during operation;
-
violation of transportation and storage conditions;
-
signs of significant wear of working parts;
-
signs of mechanical damage (drops, impacts, etc.);
-
absence of factory marking (nameplates, if available).
Consumables and rapidly wearing parts are also not covered by the warranty.
The Seller is not responsible for all risks associated with intentional or unintentional improper use of the product; damage to personnel caused by product defects; operational losses; as well as any other additional losses and expenses, including losses caused to third parties and lost profits.
The Seller is responsible for the operability and safety of the hydraulic components supplied but not for the operation process and results if actions were performed by specialists with insufficient qualifications.
Actions Upon Defect Detection
In case a defect is detected during acceptance or operation (within the warranty period), it is necessary to:
- Submit an official claim to the Seller, indicating the circumstances and describing the problem, date, and document number under which the product was purchased. When submitting a claim, it is mandatory to specify the model, serial number, and year of manufacture (if applicable), as well as provide photo or video materials demonstrating the defect, explain the nature of the malfunction, and the product’s operating conditions.
- The deadline for claims on visible defects is 3 working days from the date of product receipt. The deadline for claims on hidden defects corresponds to the warranty period but no later than 7 calendar days before the warranty expiration date. If the Seller does not receive any remarks from the Buyer, the product is considered accepted; further claims may only be made on hidden defects within the warranty period. If the product was damaged during transportation, the claim must be directed to the carrier, not the Seller.
-
If the claim can be resolved via telephone or written consultations, the Seller sends a new spare part to replace the defective one (with replacement instructions) free of charge under warranty, with transportation costs borne by the Buyer.
-
If the cause of the defect and warranty case cannot be established based on the Buyer’s materials, the product is sent to the Seller’s warehouse at the Buyer’s expense. The product must be returned in original or protective packaging preventing damage during transportation. Further, the Seller prepares an acceptance report and conducts diagnostic and repair work on the product, performs diagnostics, and prepares a technical conclusion on the product’s condition.
If, based on diagnostics, the case is recognized as a warranty case, the Seller fulfills warranty obligations in the following order:
- repair;
- price reduction if the identified defect does not affect the product’s consumer properties;
- replacement with an identical product;
- if replacement is impossible – refund of the product’s cost or part thereof, if part of the product is deemed usable.
Shipment is made on EXW Seller’s warehouse terms; transportation costs are paid by the Buyer.
If the case is not recognized as warranty-covered, the product is returned within 5 (five) working days after notifying the Buyer and receiving payment from the Buyer for:
1. diagnostics (in case of refusal of subsequent repair or replacement);
2. repair or replacement of the defective product;
3. storage costs from the moment the product is transferred for diagnostics until its return to the Buyer.
Warranty Repair Time
Warranty repair at the Seller’s service center, if spare parts are available, is performed within 10 working days from the date the equipment arrives at the service center. If spare parts are unavailable, the repair time is extended by the delivery time of these parts and agreed with the Buyer additionally.
General Information
Technical specifications and intended use of the product are indicated in the catalog and on the official Seller’s website (www.hydravia.ru). Transportation conditions and safety requirements are additionally specified in the operation manual.
Unresolved claims cannot be a reason for the Buyer to delay payment to the Seller.
The Seller reserves the right to make technical changes to the product without notifying Buyers.
